1. About these Terms
These Terms govern your use of the Telefone application and related services (the "Service"). The Service is operated by Future Replacement Intelligent Digital Assistant Youth, [CONFIRM LEGAL ENTITY TYPE AND EXACT REGISTERED NAME], with its registered address at [FULL REGISTERED ADDRESS, INDIA] (“Telefone”, “we”, “us”, or “our”).
When these Terms are presented to you for acceptance, accepting them creates an agreement between you and Telefone. If you do not agree, do not register for or use the Service.
Our Privacy Policy forms part of these Terms and should be read alongside them. It explains personal-data processing, providers, retention, and privacy choices. Its specific protections apply to personal-data handling; these Terms do not expand the purposes for which we may use your data.
Accepting these Terms does not replace any separate consent required for personal-data processing or device permissions. You can withdraw consent and manage optional features as described in the Privacy Policy. Additional terms for a future optional service will be presented before you choose to use it and apply only to that service.
2. Eligibility and your account
You must be at least 18 years old and legally able to enter into this agreement. You must provide accurate registration information, use a phone number you are authorized to use, and keep your account information current.
Protect your device, verification codes, credentials, and any recovery information. Do not impersonate another person, transfer your account without our permission, or allow others to misuse it. Notify support@telefone.live promptly if you suspect unauthorized access or lose control of your registered phone number. You are responsible for your own use and use you authorize; these Terms do not automatically make you responsible for every unauthorized action.
3. What Telefone provides
Telefone provides internet-based voice and video calls, messaging, media and file sharing, groups, and available optional features such as contact discovery, translation, speech tools, and location sharing. Availability may depend on your device, operating system, network, region, permissions, and app version.
You need a compatible device and internet connection. Your carrier or internet provider may charge for data, roaming, SMS, or other connectivity. You are responsible for those charges.
We may maintain, update, or change the Service. We will give reasonable notice of changes that materially reduce the Service where practicable, except when urgent security, legal, or operational needs require earlier action.
4. Free service and connectivity charges
Telefone is currently free to use. We do not charge registration, subscription, messaging, voice-call, video-call, or other service fees for the features currently offered in the app.
Telefone requires an internet connection. Your mobile carrier or internet provider may charge for data, connectivity, or roaming under your plan. Those charges are separate from Telefone and are your responsibility.
If we introduce charges in the future, we will notify you in advance and provide the applicable pricing and payment terms before asking you to agree. We will not charge you or enroll you in a paid service without your agreement.
5. Acceptable use
Use Telefone lawfully and respect other people. These rules apply to direct messages, calls, groups, profiles, shared files, and every other part of the Service. You must not:
- Harass, threaten, stalk, exploit, or defraud anyone, or promote violence or criminal activity.
- Share child sexual abuse material, non-consensual intimate imagery, unlawful sexual content, or content that infringes privacy, intellectual property, or other legal rights.
- Impersonate someone, conduct scams, or distribute deceptive manipulated media or unlawful misinformation.
- Send spam, make abusive repeated calls, harvest other users' information, or run unauthorized bulk messaging or automated account creation.
- Scrape or collect other users' messages, profiles, contacts, or locations without authorization, including for datasets or AI training. This does not restrict lawful use of your own content or rights protected by law.
- Offer illegal goods or services, facilitate child exploitation, or organize terrorist or other unlawful violent activity.
- Share malicious software, access accounts or systems without authorization, bypass security or usage restrictions, or disrupt the Service.
- Use the Service for any other activity prohibited by applicable law.
Do not evade a suspension by creating replacement accounts. Responsible security research must respect other users' privacy and avoid disruption; contact legal@telefone.live to coordinate a report.
6. Your content and communications
You retain ownership of content you share. You are responsible for having the rights and permissions needed to send it, including other people's contact details, images, voice, and location.
You give Telefone a limited, non-exclusive, worldwide, royalty-free permission to transmit, store, and technically process your content only as necessary to provide, secure, and maintain the Service and comply with law. Service providers may perform those tasks on our behalf under appropriate restrictions. This permission does not transfer ownership or grant a right to use private communications for advertising. It ends when the content is deleted from our systems, except for lawful retention described in the Privacy Policy.
The permission operates within the Service's technical design; it does not grant access to the plaintext of end-to-end encrypted communications. Recipients can independently save, copy, record, or forward material they receive. Deleting content or closing an account may not remove copies held by others.
Group administrators may manage membership and available group settings. They must exercise those controls lawfully and are not Telefone representatives merely because they administer a group.
7. Privacy, security, and storage
Our Privacy Policy describes the information we process, encryption, retention, providers, and privacy choices. Supported messages and attachments are end-to-end encrypted. Calls use encrypted WebRTC media connections. Encryption does not protect against every risk, including a compromised device or a recipient sharing content. Direct calls may expose your network address to another participant.
We do not sell your personal data or use private messages, call content, or contact lists to target advertisements. We still process account information, delivery and call metadata, and diagnostics as described in the Privacy Policy. Encryption is not a promise of anonymity or the absence of server records.
Telefone is not a permanent archive. Messages and attachments may become unavailable because of retention limits, device loss, app removal, account closure, or technical failure. Do not assume that changing devices or reinstalling the app will restore your history. Any available recovery feature is subject to its stated limitations.
8. Optional features
Contacts: Discovery is optional and uses hashed phone-number matching. Matches require mutual discovery participation and the relevant contact information. You can connect by username without enabling discovery. Use discovery and contact-card sharing only when you are entitled to share or allow processing of that information. Turning off discovery through its controls requests deletion of uploaded tokens; revoking device permission alone does not delete them or remove existing conversations.
Location: Share location only with intended recipients and with any necessary permission. Location may be inaccurate, delayed, or unavailable. Live sharing can continue for its selected duration, including in the background where enabled. Stopping a share does not erase information already received. Do not use location sharing to track someone without authorization.
Translation and speech: Automated translations, transcriptions, and speech output can contain mistakes or change meaning. Verify important information with the original speaker or an appropriately qualified person before relying on it, especially for health, legal, financial, or safety decisions.
In-app translation and supported Android speech recognition use on-device processing, subject to device and language availability. Language-resource downloads need connectivity. External translation links open services whose terms and privacy policies apply to information you choose to enter there. These features are not a promise of live call interpretation or certified translation.
Identity recovery: If you set up a recovery passphrase, the app encrypts your private identity key on your device and uploads the encrypted backup and associated verification information. The recovery request does not send your passphrase or unencrypted private key to our server. Recovery requires the passphrase and account verification. This backs up identity keys, not chat history or media. We cannot promise restoration of lost conversations or recovery when required credentials or data are unavailable. Support will not ask you to send your passphrase.
Recording: If you record or redistribute a conversation using your device or another tool, you must obtain any legally required permission from participants.
9. Third-party services and software
The Service may interact with app stores, operating systems, maps, networks, and other third-party services. Their applicable terms govern your separate use of them. Third-party outages or restrictions may affect Telefone. This does not remove our responsibility for obligations that apply to us by law.
We grant you a limited, non-exclusive, non-transferable license to use the app for its intended purposes while you comply with these Terms. Telefone and its licensors retain rights in the app, branding, and other materials we provide. Applicable open-source licenses govern their respective components. Nothing here restricts rights that applicable law or those licenses expressly permit.
10. Reports and grievances
Report abuse, account issues, or suspected rights violations to support@telefone.live. Include enough information to identify the account, incident, or content and explain your concern. Submit only material you are lawfully entitled to share; do not send passwords or verification codes. We may request additional information necessary to investigate.
- Grievance Officer: [NAME AND DESIGNATION]
- Contact: [CONFIRMED GRIEVANCE EMAIL AND POSTAL ADDRESS]
You can use available blocking controls to restrict unwanted contact. If you voluntarily submit message text, screenshots, or other evidence, support can review that submitted material. We do not promise access to encrypted message plaintext that our systems do not possess. Do not submit recovery passphrases. Copyright complaints should identify the protected work, alleged infringement, and your authority to act.
We will acknowledge and handle complaints within the periods required by applicable law, including shorter periods for urgent categories. Where available under applicable law, you retain the right to seek external review or approach the appropriate authority or court. You may request review of an account restriction through support@telefone.live.
11. Suspension and account closure
We may restrict or suspend access where reasonably necessary to address a material breach, fraud, abuse, security threats, or a legal requirement. Where lawful and practicable, we will explain the reason and provide an opportunity to correct the issue or request review. Immediate action may be necessary to protect users or the Service.
You may stop using Telefone at any time. To request account closure and deletion, contact support@telefone.live. We may reasonably verify your identity. Uninstalling the app does not itself close your account. Personal data is handled under the Privacy Policy and applicable retention requirements; copies held by recipients are outside our deletion control.
Account-deletion requests include the identity backup associated with the account, subject to applicable retention requirements. There is no automatic inactive-account deletion feature. These Terms do not promise automatic message expiry or deletion from every recipient's device. Ending this agreement does not remove rights or obligations that by their nature continue, including accrued claims, lawful retention, intellectual-property rights, and dispute provisions.
12. Availability and responsibility
We will exercise reasonable care in providing the Service. To the extent permitted by applicable law, we do not promise uninterrupted or error-free operation, delivery of every communication, or suitability for every purpose.
To the extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable when you accepted these Terms. Nothing in these Terms excludes or limits responsibility for fraud, wilful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. Your mandatory consumer and other statutory rights remain unaffected.
13. Changes to these Terms
We may update these Terms as the Service or legal requirements change. We will make the revised Terms available and give reasonable advance notice of material changes where practicable. Changes will apply prospectively from the stated effective date. Where fresh acceptance is required, we will request it. If you disagree, you may stop using the Service and request account closure.
14. Governing law and disputes
Subject to mandatory laws and rights applicable to you, these Terms are governed by Indian law. Disputes may be brought before competent courts in [CITY AND STATE, INDIA], subject to jurisdiction requirements and any right you have to approach a consumer forum, regulator, or another court under applicable law. You may contact support@telefone.live to seek an informal resolution, but doing so is not a condition for exercising statutory remedies.
If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible. A delay in enforcing a provision does not waive the right to enforce it later.

Drafting notes (remove before publication)
This draft reflects the mobile repository and its existing Privacy Policy, not an audit of the deployed service. Obtain Indian legal review and review for other launch countries before publication.
Confirm the legal operator, entity type, address, launch countries, 18+ policy, effective date, jurisdiction, public policy URL, and working support/legal/grievance contacts. The operator has confirmed that the current app is free to use.
The repository's privacy checklist contains unresolved release tasks, including retention enforcement, account-erasure operations, age checks, and recovery-backup configuration. Align the published policies with actual operations. Do not treat this document as implementing acceptance, deletion, moderation, or complaint handling.
Have counsel verify applicable intermediary obligations, complaint deadlines, appeal disclosures, and commencement dates. A privacy-request response target must not be reused for every category of content complaint.
The current onboarding flow records privacy consent, not separate acceptance of these Terms. Before these Terms become effective for users, provide an accessible Terms link, appropriate affirmative acceptance, and a versioned acceptance record; handle existing users and material revisions as required. Do not relabel prior privacy consent as Terms acceptance.
No current payment, subscription, cancellation, or refund workflow is represented by these Terms. If paid services are introduced, prepare the relevant purchase, renewal, cancellation, and refund terms before launch. Replace the relative Privacy Policy link with its confirmed public URL when publishing outside this repository.
